What Exactly is the EMV Liability Shift?

EMV chip cards use that chip you see to create a unique transaction code every single time they are used. The ever-changing payment information makes these cards practically impossible for criminals to duplicate.

Currently, if an in-store transaction is conducted using a counterfeit, stolen or otherwise compromised card, consumer losses from that transaction fall back on the payment processor or issuing bank, depending on the card’s terms and conditions.

After the October 1, 2015, deadline created by major U.S. credit card issuers American Express, MasterCard, Visa, and Discover, the liability for card-present fraud will shift to whichever party is the least EMV-compliant in a fraudulent transaction.

Eligibility for the Lightspeed EMV Liability Promise

All Lightspeed Retail merchants that subscribe for Lightspeed Retail point of sale services:

THAT:

  • Are subscribed for Lightspeed Retail (S-Series) point of sale services and have ordered an EMV-capable iCMP, iPP320, iPP350, or Link/2500 credit card reader from Lightspeed;
  • AND

  • Are currently using a third-party credit card processor who referred the merchant to Lightspeed Retail through our official Partner Program;
  • AND

  • Are customers in good standing at the time of presentation to Lightspeed of the EMV related liability shift chargeback in question.
  • Overview of the Lightspeed EMV Liability Promise

    Eligible Lightspeed Retail merchants will be covered for up to $500 of EMV-related chargebacks that are determined to be fraudulent via the terms and conditions below.

    EMV-related chargeback transactions must have been processed on an iCMP, iPP320, iPP350, or Link/2500 using a chip enabled card that contained counterfeit magstripe that was swiped (not dipped) to process the transaction, and a signature was captured in connection with processing that transaction.

    If Lightspeed determines that your chargeback is covered by Lightspeed’s EMV Liability Shift Protection, Lightspeed will refund the amount of the EMV related transaction that was charged back.

    FAQ

    How do I know if I am eligible for the promise?

    You are a Lightspeed Retail merchant who

  • Subscribed for Lightspeed Retail (S-Series) point of sale services and ordered an EMV-capable iCMP, iPP320, iPP350, or Link/2500 credit card reader from Lightspeed; and
  • Is currently using a third-party credit card processor who referred you, the merchant, to Lightspeed through our official Partner Program; and
  • And are a customer in good standing at the time of presentation to Lightspeed of the EMV related liability shift chargeback in question.
  • When and for how long will I be covered?

    Lightspeed’s EMV related liability shift protection is in place for eligible EMV related charged back transactions that occur on or after October 1, 2015 and are presented to Lightspeed before December 31, 2020 (which date may be extended by Lightspeed at Lightspeed’s sole discretion) by Lightspeed Retail merchants that meet Lightspeed’s Merchant Qualification.

    If I am eligible and I have an EMV-related chargeback, what should I do?

    If you are an eligible Lightspeed Retail merchant and have an EMV-related chargeback you must email [email protected] with the following information:

  • Your contact information
  • Lightspeed Retail account name
  • Lightspeed Retail Store order number with iCMP, iPP320, iPP350, or Link/2500
  • iCMP, iPP320, iPP350, or Link/2500 serial number
  • All chargeback documentation from your processor
  • How much will be covered for the chargeback?

    A maximum total of up to $500 of Lightspeed approved EMV related chargebacks for each Lightspeed Retail merchant will be eligible for refund by Lightspeed. In no event will any Lightspeed Retail merchant be eligible for more than a total of $500 for all EMV related chargebacks incurred by any Lightspeed Retail merchant pursuant to Lightspeed’s EMV Liability Promise.
